What is arbitration?
Arbitration is a dispute resolution mechanism through which the parties submit their dispute to an impartial third party or an arbitral tribunal to obtain a final and binding decision.
Unlike mediation, arbitration does not focus on helping the parties negotiate a voluntary agreement, but rather on obtaining a formal resolution through an arbitral proceeding.
How arbitration works at CMA-BCS
CMA-BCS does not administer arbitrations. However, when warranted by the matter, the parties may send an email to direccion@cma-bcs.com so that CMA-BCS may review the case and verify the existence of an applicable arbitration agreement or arbitration clause. If the existence of an arbitration agreement or arbitration clause is confirmed, CMA-BCS will send an email containing the information regarding the dispute to the Colegio de Corredores Públicos del Estado de Jalisco, A.C., copying the parties and notifying them of the referral of the matter, subject to the applicable requirements and to the acceptance of the case by that institution. From that moment on, the Colegio de Corredores Públicos del Estado de Jalisco, A.C. shall be responsible for the administration of the arbitration proceeding, as well as for conducting the subsequent communications and actions.

Arbitration may be appropriate when:
