Conciliation
An impartial recommendation to help resolve your dispute.
What is conciliation?
Conciliation is an alternative dispute resolution mechanism in which an impartial third party reviews the case and issues a non-binding recommendation on the most suitable resolution for the parties.
Unlike mediation — where the parties build their own agreement with the mediator's support — in conciliation the conciliator can actively suggest the terms of a possible solution. Unlike arbitration, that recommendation does not bind the parties; it serves as an informed starting point for negotiation.
Key characteristics of conciliation
Non-binding recommendation
The conciliator proposes a resolution, but the parties retain the freedom to accept, modify, or reject it.
Impartial evaluation
A neutral third party reviews the case and offers a professional opinion on how it might be resolved.
Flexibility
The procedure adapts to the parties' needs and to the nature of the dispute.
Preserves relationships
By avoiding an imposed decision, conciliation makes it easier to continue the commercial or personal relationship between the parties.
